HIPAA Notice of Privacy Practices

Our Commitment to Your Privacy

Desert Mountain Healing IOP is committed to protecting the privacy of your health information. We are required by law to:

• Maintain the privacy of your protected health information (PHI)
• Provide you with this notice of our legal duties and privacy practices
• Follow the terms of the notice currently in effect
• Notify you if we are unable to agree to a requested restriction
• Accommodate reasonable requests to communicate health information by alternative means or locations

How We May Use and Disclose Your Health Information

Treatment

We may use and disclose your health information to provide, coordinate, or manage your treatment and related services. This includes coordination of care with other healthcare providers.

Example: We may share information with your primary care physician or psychiatrist to coordinate comprehensive care.

Payment

We may use and disclose your health information to obtain payment for services we provide. This includes billing and collections activities.

Example: We may submit claims to your health insurance company containing information about your diagnosis and treatment.

Healthcare Operations

We may use and disclose your health information for healthcare operations, including quality improvement, staff training, business planning, and compliance activities.

Example: We may use your information to assess treatment effectiveness or train staff members.

Disclosures Required or Permitted by Law

We may use or disclose your health information when required or permitted by law, including:

• When required by court order, subpoena, or other legal process
• To public health authorities for disease prevention and reporting
• To report suspected abuse, neglect, or domestic violence when required by law
• To health oversight agencies for authorized investigations and audits
• For law enforcement purposes in specific circumstances

Your Rights Regarding Your Health Information

Right to Access

You have the right to inspect and obtain a copy of your health information. To request access, submit a written request to our Privacy Officer. We may charge a reasonable fee for copying and mailing costs.

Right to Amend

You have the right to request that we amend your health information if you believe it is incorrect or incomplete. We may deny your request in certain circumstances, such as if the information was not created by us or if it is already accurate and complete.

Right to an Accounting of Disclosures

You have the right to receive a list of disclosures we have made of your health information, excluding disclosures for treatment, payment, healthcare operations, and certain other disclosures.

Right to Request Restrictions

You have the right to request restrictions on certain uses and disclosures of your health information. We are not required to agree to all restrictions, but if we do, we will comply unless the information is needed for emergency treatment.

Right to Request Confidential Communications

You have the right to request that we communicate with you about health matters by alternative means or at alternative locations. We will accommodate reasonable requests.

Right to a Paper Copy of This Notice

You have the right to receive a paper copy of this notice at any time, even if you have agreed to receive it electronically.

Special Protections for Substance Use Disorder Records

Information about substance use disorder treatment is protected by federal regulations (42 CFR Part 2) in addition to HIPAA. These records generally cannot be disclosed without your written consent except in specific circumstances permitted by law.

Changes to This Notice

We reserve the right to change this notice and make the new provisions effective for all protected health information we maintain. If we make material changes, we will provide you with a revised notice.
